By downloading, installing, or using the App, you agree these Terms form a legally binding agreement. If you don't agree, don't use the App.
1. What the App Does
- zuup Roam helps you find, start, and pay for EV charging sessions across third-party charging networks ("CPOs").
- We don't own, operate, or maintain charging stations. We just make access easier through one app and account.
2. Fees & Payments
- zuup sets the pricing for charging sessions shown in the App, including any discounts that may apply under subscriptions or promotions.
- Idle fees, if applicable, are determined by the CPO and passed through by zuup.
- Payments are charged automatically to your chosen payment method.
3. Subscriptions
- Subscription plans (if you choose one) are billed in advance on a recurring basis.
- You can cancel anytime via the App; your plan runs until the end of the current billing cycle.
4. Refunds
- Refunds are only provided as required by Australian Consumer Law.
- If there's a problem with a charging session, contact us and we'll do our best to help resolve it.
5. Your Responsibilities
- Make sure your vehicle and equipment are safe and compatible with the charger.
- Don't misuse, damage, or tamper with charging stations.
- You're responsible for your account login details and any activity under it.
6. Indemnity
- You agree to indemnify zuup against any loss, cost, or claim that arises from your misuse of the App, chargers, or your account. This means if your actions cause damage, costs, or legal claims, you're responsible for them, not us.
7. Service Changes
- We may update or remove features, add or remove CPOs, or change pricing arrangements from time to time.
- We'll aim to give notice in the App if major changes happen.
8. Third-Party Services
- The App may show info from third parties (charging operators, maps, points of interest).
- We don't control and aren't responsible for the accuracy or availability of that info.
9. Privacy
- By using the App, you also agree to our Privacy Policy, which explains how we handle your personal data.
10. Disputes
- If you've got a dispute, contact us first so we can try to sort it out.
- If we can't resolve it, disputes will be handled under the laws of Victoria, Australia.
11. Limitation of Liability
- We're not responsible for the uptime, speed, or condition of third-party chargers.
- To the maximum extent permitted by law, we're not liable for indirect, incidental, or consequential losses.
12. Force Majeure
- We're not liable if we can't provide the App or related services because of things outside our control - like natural disasters, power outages, network failures, government actions, or strikes.
13. Intellectual Property
- All content, branding, and software in the App belongs to Zuup Pty Ltd.
- Don't copy, modify, distribute, or reverse-engineer the App.
14. Termination
- We can suspend or close your account if you breach these Terms.
- You can stop using the App anytime by deleting your account and uninstalling it. Any outstanding charges remain payable.
15. Updates to These Terms
- We may update these Terms from time to time. We'll notify you of material changes via the App or email.
- The latest version will always be available in the App, and your ongoing use means you accept any changes.
16. General
- These Terms are the entire agreement between you and zuup about use of the App. If a court finds any part of these Terms invalid or unenforceable, the rest still applies.
